  • The arrestee was acquitted at trial, or the statute of limitation on the criminal offense has expired.

To expunge eligible arrest records, the arrestee must obtain a certificate of eligibility from the Utah Bureau of Criminal Identification (BCI). With this document, they can file a "petition to expunge records" with the court within ninety (90) days of receiving the certificate. Individuals who cannot file their application within the stipulated 90-day time frame may reapply for the certificate.

Under Utah Rule of Criminal Procedure 42, the court must provide a copy of the petition to the prosecutor handling the case. The prosecutor then has 35 days to review and respond to the petition. If the prosecutor denies the petition, the court must hold a hearing.
