Sevier County Arrest Records

Per the Utah Code, chapter 7, 77-7-1, an arrest is the detention or restraint of a person on account of a crime. Utah peace officers typically conduct an arrest if the individual is deemed responsible for a crime, probable cause exists, or if under the authority of a warrant. Arrested inmates are confined in a correctional facility overseen by the Sevier County Sheriff's office, which is also responsible for initiating the arrest.

Arrest records are documents generated at various points throughout the criminal justice system. These records comprehensively overview an individual's interaction with the justice system, detailing the number of arrests, fines/charges, and dispositions. Criminal case records are transferred after a specific period from the court and preserved with the Utah Division of Archives and Records Service. Arrest information is generally linked to the Courts Information System (CORIS). It is accessible through the Sevier County court records, criminal history filed by the Utah Bureau of Criminal Identification (BCI), and the District/Justice clerk's office.

Are Arrest Records Public in Sevier County

Yes. Sevier County arrest records are public records unless stated otherwise by the law. Utah Code Title 63G-2-201 Chapter 2. GRAMA allows individuals to inspect and make duplicate copies of public records during official hours at no cost. Nonetheless, the provisions of this code are not absolute. Still, conditional access is influenced by the nature and sensitivity of the record to safeguard lives, protect properties, and the integrity of an ongoing investigation.

Arrest information that may be restricted from public disclosure includes:

  • Juvenile delinquency record
  • Expunged/sealed record
  • Records that disclose the techniques of an ongoing investigation
  • Offender's identity record
  • Medical history or related record
  • Information that may deprive a person of a fair hearing
  • Witness statement or identity disclosure
  • Records that may endanger the safety/welfare of public personnel or parties involved in a case.

Sevier County public arrest records may not reflect the outcome of a case.

What Do Public Arrest Records Contain?

A typical public arrest record contains the arrestee's information, arrest details, and the identity of the law enforcement personnel/agency initiating the arrest. Details include:

  • The offender's name/date of birth
  • Offender's address and occupation
  • Date of arrest/booking
  • Booking information (number, date and location)
  • Release date (where applicable)
  • Filed charges/court orders
  • Any property involved in the arrest incidence

How Long Do Arrests Stay on Your Record?

Forever. However, the Utah Petition for Expungement 77-40a-305 outlines eligible criteria for expunging an arrest record from public view.

Expunge Sevier Arrest Records

Expungement is the legal process that removes an offense from a person's criminal history so that, for most purposes, it is as if the crime never occurred. Once a record is expunged, it is sealed from public view and may be accessed only by:

  • court order,
  • governmental agencies with statutory authority, or
  • a party that obtains specific permission from the court.

A record is eligible for expungement only when all of the following conditions are met:

  • The criminal case is fully concluded.
  • No other criminal charges are pending (traffic infractions are exempt).
  • All legal obligations are satisfied—fees, fines, interest, and restitution, if any, are paid in full.
  • The individual is not currently on probation, parole, or incarcerated.
  • No active civil or criminal protective orders or court injunctions remain in force.

Certain cases qualify for automatic expungement, while others require a petition to the Utah courts.

Case Type Waiting Period* Additional Limits
Acquittal or Dismissal None (automatic)
Plea in Abeyance – Class A drug possession 7 years from date the plea was accepted Maximum of 2 such cases
Plea in Abeyance – Class B misdemeanors 6 years from plea acceptance Maximum of 3 such cases
Class C misdemeanors, minor regulatory offenses, infractions 5 years from entry of judgment
Eligible felonies Statutory period satisfied and all financial obligations paid

The waiting period starts on the date indicated and runs only if no new criminal cases are filed and all fees are paid in full.

Once the Utah Supreme Court (or appropriate district court) grants expungement:

  • The record is sealed and removed from public databases.
  • Published opinions are re-issued in redacted form, replacing full names with initials (e.g., "D.P". for "Derrick Parsons").
  • The defendant may notify third-party publishers to substitute or remove the original opinion in favor of the redacted version.

Sevier County Arrest Warrants

An arrest warrant is a standing order issued by a Judge to detain a criminal offender. An active Sevier County arrest warrant can be accessed via the Utah Statewide Warrants File (SWW), a centralized platform to provide information on the state's 'Most Wanted' individuals. These data are from court information transferred electronically to the Utah Criminal Justice Information System (UCJIS).

The following information is highlighted in a Sevier County arrest warrant:

  • Offender's name
  • The date/county/city warrant was issued
  • The crime committed by the defendant
  • Defendant bail amount
  • The title of the office and the signature of the issuing authority
  • The agency or court issuing the warrant

However, due to the system's reliance on the court's information, warrant search via SWW may not be accurate as timely update/removal or entry of records are critical to its operations.

Do Sevier County Arrest Warrants Expire?

No. A Sevier County arrest warrant is not time-bound and does not expire. Law enforcement agencies are, therefore, obligated to commence an arrest at any given time on the individual named in the warrant. However, a long-standing warrant may be recalled at a Judge's discretion. The Judge may issue a bench warrant whose existence is also indefinite upon the failure of an offender to appear in court or comply with the judicial order.

However, Utah courts mandate the periodic review of long-standing bench warrants to determine possibilities for recall.
