How Does The Utah Juvenile Court Work?

The Utah Juvenile Court shares equal authority with the District Court. The Juvenile Court has exclusive original jurisdiction over offenses committed by persons under the age of eighteen when the offense was committed and under twenty-one at the time of the court proceedings. The court hears cases involving the violation of federal, state, or municipal law and cases of child abuse and negligence.

The court has the authority to give verdicts on child custody, support, and visitation rights. It may also decide to permanently terminate parental rights and authorize a child’s commitment to a local mental health facility. In juvenile delinquency matters, the Juvenile Court may punish minor offenders by fines for their delinquent acts. Youths that social service agencies deem ungovernable due to their habitual actions, such as running away from home, are usually handled by the Juvenile Court. The court may put such minors under the supervision of the court’s probation department. In some cases, the court may authorize the minors’ placement in the care of foster homes and other institutions that offer such services.

In cases that involve child abuse, negligence, or dependency, the court works with the Office of Guardian ad Litem to resolve matters that may arise.

While the District Court hears traffic violation cases, the Juvenile Court has exclusive jurisdiction of traffic crimes committed by minors. The court shares jurisdiction with both the District Court and Justice Court in matters involving an adult abetting a minor’s delinquent actions.

The Juvenile Court maintains a probation department, and the probation officers are responsible for the preparation of reports and the supervision of minors placed on probation by the Court. The probation officers also conduct assessments to determine the progress of each juvenile. The Juvenile Court records are managed by the clerical division. The Utah Juvenile Court consists of thirty-one judges and fifteen commissioners. The judges are assisted by commissioners who are trained as attorneys.

The Juvenile Court also handles cases involving the supervision of minors who move to Utah from another state where they were under court supervision. The Utah Court of Appeals hears all appeals from the Juvenile Court.
