How Does The Utah Justice Court Work?

In Utah, Justice Courts are functional in all counties and municipalities, and they have jurisdiction over the following matters:

• Offenses under the categories of class B misdemeanor and class C misdemeanor
• Cases involving violations of ordinances
• Small claims of up to $10,000
• Traffic infractions that occur within their jurisdiction

The jurisdiction of each Justice Court is dependent on the territorial borders of the local entities, including the state’s cities and counties.

Justice Courts judges are appointed by their respective county commission and stand for retention election every six years. However, the Municipal judges of the Justice Courts are appointed by city officials and serve a six-year term. The judges’ work schedule differs among various counties as some hear cases daily, while others have a limit of cases to hear during a week. Unlike other Utah Courts, The Justice Court judges are not mandated to be attorneys to qualify for the post. However, they receive adequate extensive legal training. All Utah Justice Court judges must complete 30 hours of continuing judicial education annually to remain certified. The Utah Justice Court consists of 81 judges who serve in 115 Justice courts across different cities and counties.
